Terms of Service

These terms apply to services provided by Fix It 44 LLC, doing business as Kelvex Heating & Air ("Kelvex", "we", "us"), to the customer requesting service ("you"). By requesting or accepting service, you agree to these terms.

Services provided

Kelvex provides commercial heating, ventilation and air conditioning services, including diagnostics, repair, preventative maintenance and seasonal service on light-commercial equipment. Services are performed at the service address you provide, during business hours unless otherwise arranged.

Quotes and approval

Repair work is quoted in writing before work begins. Quotes itemize parts and labor and state any exclusions.
Quotes are valid for 30 days from the issue date unless stated otherwise.
Work outside the approved scope is not performed without your written approval by change order.
Diagnostic visits are billed at the stated diagnostic rate whether or not repairs are subsequently approved.

Payment terms

Payment is due upon receipt of invoice unless written terms have been agreed in advance.
We accept credit and debit cards, ACH bank transfer, and check. Card payments are processed by Stripe, Inc. Kelvex does not store full card details.
A deposit may be required on jobs with significant parts cost; any deposit will be stated on the quote.
Past due balances may accrue interest at the lesser of 1.5% per month or the maximum permitted by Colorado law.
Parts remain the property of Kelvex until paid for in full.

Cancellation and refunds

Scheduled visits. You may cancel or reschedule at no charge with at least 24 hours' notice. Cancellation with less than 24 hours' notice, or inability to access the equipment on arrival, may be billed at the diagnostic rate.
Approved work not yet started. If you cancel approved work before it begins, you are responsible for any special-order parts already purchased and any restocking fees charged by the supplier. Any remaining deposit balance is refunded.
Work in progress. Work already performed is billable. Cancellation mid-job does not void charges for labor performed and parts installed.
Maintenance agreements. Either party may cancel with 30 days' written notice. Prepaid visits not yet performed are refunded on a pro-rata basis.
Refunds. If a refund is due, it is issued to the original payment method within 10 business days. If you believe you have been billed in error, contact us at michael@kelvexhvac.com and we will review and respond within 5 business days.

Warranty

Parts supplied by Kelvex carry the manufacturer's warranty. Labor is warranted for 30 days from the date of service on the specific repair performed. Warranty excludes: unrelated failures, conditions noted as excluded on the quote, damage caused by lack of maintenance, freeze damage, misuse, or work performed by others. Warranty is void where invoices remain unpaid.

Customer responsibilities

Providing safe and lawful access to equipment, including roof access, keys and codes as needed.
Ensuring power and water are available at the equipment where required.
Disclosing known hazards or prior work on the equipment.

Limitation of liability

Kelvex is not liable for indirect, incidental or consequential damages, including lost business, spoiled inventory or lost revenue arising from equipment failure or downtime. Our total liability for any claim is limited to the amount paid for the specific service giving rise to the claim. Nothing in these terms limits liability that cannot be limited under Colorado law.

Pre-existing conditions

Commercial HVAC equipment is frequently aged and previously serviced by others. Kelvex is not responsible for pre-existing conditions, prior installation defects, or failures of components not included in the approved scope of work. Where such conditions are identified, they are documented on the quote or invoice.

Governing law

These terms are governed by the laws of the State of Colorado. Any dispute is subject to the jurisdiction of the courts of Broomfield County, Colorado.
